Rules and information regarding Concordia University’s Stingers 50-50 Draw

  1. General
    By purchasing, obtaining or otherwise holding an eligible ticket for the 50-50 draw (the “Draw”), you agree and undertake to adhere to the rules, terms and conditions set forth herein (the “Rules”).
  2. Eligibility
    Unless otherwise indicated in the applicable Draw materials, the Draw is open to individuals who are 18 years of age or older and who are physically located in Quebec at the time of ticket purchase. Notwithstanding the foregoing, employees of Concordia University (“Concordia”) who are directly involved in the organization, administration, promotion or operation of the Draw, and the persons with whom they are domiciled, are not eligible to purchase tickets or win a Prize.
  3. How to enter the Draw
    An individual who enters the Draw (the “Participant”) must purchase or otherwise obtain an eligible 50-50 draw ticket from a platform authorized by Concordia to sell or issue tickets for the Draw (each an “Entry”). Entries must be purchased or obtained when in progress on the platform (the “Entry Period”). The end time of each draw is available on the platform. Incomplete, late, ineligible, forged, altered, duplicated, cancelled, unpaid or non-compliant Entries may be disqualified from the Draw.
    The ticket price, available ticket packages, maximum number of tickets available for sale, permitted number of Entries per Participant, sales channels, payment methods, and any applicable purchase or participation conditions will be set out on the Platform.
    Entries may not be purchased, obtained, or submitted by a Participant on behalf of another person unless expressly permitted by Concordia. Once an Entry has been purchased, obtained, or recorded, it is considered final and may not be altered, transferred, substituted, cancelled, refunded, or revoked by the Participant, except as otherwise expressly permitted by Concordia.
  4. Use of Participant information
    By entering the Draw, the Participant grants Concordia the right to use, publish or broadcast the Participant’s name, likeness, statements, ticket number, faculty, department, affiliation or other Draw-related information for Draw administration, winner notification, advertising, publicity, reporting and archival purposes, in any media that Concordia may choose, at its sole discretion, without further compensation or authorization, except where prohibited by law. The Participant releases Concordia from all claims related to the foregoing.
  5. Method of selecting the winner
    After the conclusion of the Entry Period, one winning ticket number will be selected by random draw using certified software from all eligible Entries received during the Entry Period. The holder of the winning ticket number who satisfies the eligibility requirements and complies with these Rules will be declared the winner of the Prize listed in Section 6 hereof (the “Winner”). The draw will take place at the end of the entry period or at such other date, time or location as Concordia may determine in accordance with applicable law and any applicable license or authorization. or authorization.
    The winning participants' name and ticket number, and prize will be shown on the platform where the ticket was purchased.If possible, the winner's name will also be announced during the game by the announcer and shown on the scoreboard.
    If the selected Entry is determined to be ineligible, invalid, cancelled, unpaid, forged, altered, duplicated, non-compliant or otherwise disqualified, Concordia may disqualify that Entry and select an alternate winning ticket number by random draw from the remaining eligible Entries.
  6. Prize
    The Prize to be awarded in the Draw is equal to fifty percent (50%) of the gross proceeds received by Concordia from eligible ticket sales for the Draw, or such other percentage or amount as may be specified in the applicable Draw materials and authorized under any applicable license or approval (the “Prize”). The final Prize amount will depend on the total value of eligible ticket sales received during the Immediately after the entry period has finished the winner will be drawn from all the entries. The odds of winning depend on the number of eligible Entries received.
    Concordia will contact the person holding the winning ticket using the information provided on the website at the time of purchase.
    The winner must complete a form before claiming their prize. The form will need to be completed electronically. I link to the form will be sent to the email address provided. Only the winner may complete the form and claim the prize ID may be required.
    The form must be completed within 10 days of the draw. If it remains unclaimed within this period, despite the club's efforts to contact the winner, the fund will be carried over to the next draw for that sport in which the draw was held. If there are no further draws available for the same sport in the same season, then it will be deposited into the Concordia Stingers Fund, subject to agreement with the RACJ (Quebec Alcohol, Racing and Gaming Commission).
    The 50/50 cash prize will be paid in Canadian dollars by direct deposit within 30 business days after the winner has submitted the completed claim form and all required banking information, unless unforeseen circumstances beyond the organizer's control cause a delay.
    Winners are responsible for all taxes and fees payable to any government authorities as a result of winning a Prize.
  7. Notification and announcement of the winner
    Using the contact information associated with the selected Entry or otherwise available to Concordia, Concordia will make reasonable efforts to contact and notify the potential Winner. If the potential Winner cannot be contacted, does not respond within the time specified by Concordia, is found to be ineligible, declines the Prize, fails to correctly answer any required skill-testing question, or fails to comply with these Rules, Concordia may disqualify that potential Winner and select an alternate winning ticket number by random draw from the remaining eligible Entries.
    The public announcement of the Winner, if any, will be posted immediately after the draw on the platform used to purchase tickets. We may also add the announcement to Concordia websites, social media accounts, newsletters, digital information screens, event materials, or other communication channels.
  8. Abuse
    Participants agree and undertake not to: (i) tamper with the ticketing, entry, draw or prize-claim process; (ii) act in an unsportsmanlike, disruptive, fraudulent or abusive manner; (iii) act in a manner that undermines the legitimate operation of the Draw; or (iv) submit, obtain, purchase or attempt to use incomplete, forged, altered, software-generated, automated, duplicated, cancelled, unpaid, ineligible or otherwise non-compliant Entries.
  9. Limitation of liability and obligation to indemnify
    The Participant agrees that Concordia is not responsible for failures and other issues with the Draw, including, but not limited to: (i) issues experienced purchasing, obtaining, completing, transmitting or recording any Draw-related information or Entries through any applicable ticketing process, website, platform, form, device or system; (ii) any technical malfunctions of electronic equipment, computer systems, servers, internet providers, computer hardware or software; (iii) failure of any Entry to be received, recorded or processed by Concordia due, in whole or in part, to technical problems, software or hardware failures, traffic, congestion, viruses, Trojan horses, labour action,failure of power, riots, insurrection, war, act of God, internet issues, issues on Concordia property, or any other reason; (iv) any damage to the Participant’s computer, hardware or software which may be caused, directly or indirectly, in whole or in part, due to that Participant’s participation in the Draw or use of any applicable website, platform, form, device or system; (v) any telecommunication miscommunication or failure, failed, lost, delayed, incomplete, garbled or misdirected communications which may limit a Participant’s ability to participate in the Draw; or (vi) any error, omission, interruption, defect, delay, theft, destruction, unauthorized access, human error, administrative error or other issue affecting the administration, security, fairness, integrity or proper conduct of the Draw.
    The Participant agrees to release and hold Concordia harmless from and against any indirect, special, incidental, consequential, punitive or other damages, including any loss of profits or economic loss, regardless of the form of action, whether in contract, extra-contractual liability, tort, negligence or otherwise, arising out of or relating to the Participant’s participation in the Draw, any Entry, the Prize, or the administration of the Draw (“Claims”), even if Concordia has been advised of the possibility of such damages.
    If Concordia is made a party to any Claims commenced by or against the Participant or otherwise commenced in relation to the Draw, the Participant’s Entry, the Participant’s participation, the Prize, or the Participant’s failure to respect the present Rules, then the Participant shall protect, indemnify and hold Concordia harmless and shall pay all costs and expenses and legal fees incurred or paid by Concordia in connection with such Claims. The Participant shall also pay all costs, expenses and legal fees that may be incurred or paid by Concordia in enforcing the terms, obligations and conditions of these Rules.
  10. Disqualification
    Failure to comply with these Rules may result in a Participant’s disqualification from the Draw, at Concordia’s sole discretion.
  11. Governing law and disputes
    These Rules shall be governed by and construed in accordance with the laws of the Province of Quebec and the laws of Canada applicable therein. The parties hereby irrevocably attorny to the exclusive jurisdiction of the courts of the Province of Quebec for any legal proceedings arising out of these Rules or the performance of the obligations hereunder.
  12. SeverabilityIf any provision, or portion thereof, of these Rules is determined by a court of competent jurisdiction to be invalid, illegal or unenforceable, such determination shall not impair or affect the validity, legality or enforceability of the remaining provisions of these Rules, and each provision, or portion thereof, is hereby declared to be separate, severable and distinct.
  13. Number and gender
    Unless the context requires otherwise, words importing the singular include the plural and vice versa, and words importing gender include all genders.
